OHS Laws and you

At work you need to follow any reasonable policies and procedures relating to workplace safety- exercise a level of care and responsibility for example:

  • read the safety manuals (and some workplaces have material safety data sheets)
  • read emails and notifications about OHS matters
  • wear personal protective equipment
  • attend OHS training (for example, first aid training and evacuation drills).

In 2012, the Australian States and Territories agreed to develop model laws to base their legislation around for consistency across the nation, this was called the Australian WHS Act and Regulations. However, Victoria and Western Australia did not implement this. This is why Victoria uses terminology OHS rather than WHS.

In Victoria, the laws around OHS are the Occupational Health and Safely Act (Vic) 2004 and the Occupational Health and Safely Regulations (Vic) 2007.

If you work in states outside Victoria, refer to the legislation and the safety regulator for that particular State or Territory. In Victoria the safety regulator is WorkSafe Victoria.
